LLC or Individual Business - What to Choose for Legalization?
Foreigners who have been living in Poland for a long time know well what legalization options are available. For example, by opening a limited liability company (LLC), you can reliably count on obtaining a residence permit card. However, opening an individual business (sole proprietorship) did not previously provide the opportunity to legalize in the country. Only recently was a new law passed, and now all foreign business owners can obtain a residence permit card. Which form of business to choose for obtaining a residence permit is an excellent question, and it's difficult to answer in just one sentence. In fact, it all depends on your goals, the specifics of your business, scale, and other features. In simple terms, if you are starting a small business, it's best to register as a sole proprietor, but if you plan to build a large company, choose an LLC (Sp. z o.o.).

If you've decided to open a sole proprietorship to run a business and obtain a residence permit, you'll need to know what documents to prepare. To keep things simple, we suggest splitting them into two groups - personal documents and company-related documents.
- Passport with notarized Polish translation.
- Bank statement from the bank that cooperates with you and services your business.
- Proof that you can support yourself. You must show that you earn at least 4,242 zlotys, which is the minimum wage in Poland.
- Document confirming that your company has no debts to ZUS (social security).
- Four color photographs 3x4 cm in size.
- Document confirming that your company has no debts to the tax office.
- Health insurance.
- Business plan. This is a great way to show inspectors that your business will truly be beneficial to the country.
- Properly filled out application form expressing your desire to obtain a residence permit card.
- Postal code.
In addition, you, as a business owner, must comply with two of the most important requirements of Polish law. First, your company must employ at least two Polish citizens. Second, your company's revenue must be equivalent to at least 12 average salaries.
What You Need to Open an Individual Business in Poland?
If you're eligible to open your own business in Poland, you should know how the registration process works. An individual business (JDG) is registered with Centralna Ewidencja i Informacja o Działalności Gospodarczej. Today, you can register a business both offline and online. Whichever method you choose, you will need the following documents:
- Document proving your identity.
- PESEL number (if available)
- Digital signature ePuap (in case of online registration).
